Disclosures

Last updated: January 29, 2026

1. Purpose of This Page

This Disclosures page explains important information about the nature of Sun Cluster Inc.’s products and services and the risks associated with using software that can automate trading activities. It is intended to help you make informed decisions about whether and how to use our software and services.

2. Who We Are (Software Company)

  • Sun Cluster Inc. is a Canadian software engineering company.
  • Address: 1338 Wellington Street West, Unit 10, Ottawa, Ontario, K1Y 3B7, Canada
  • Website: suncluster.ca
  • Contact: contact@suncluster.ca
  • We build custom software (including automated trading bots/systems) and provide single-client deployments of a private trading web application (sometimes referred to as a “Trading Desk App”).

3. No Brokerage, No Custody, No Investment Advice

  • Sun Cluster Inc. is not a broker, dealer, investment adviser, portfolio manager, or any other regulated intermediary. We do not provide investment advice, trading recommendations, or personalized financial guidance.
  • We do not accept customer deposits, and we do not take custody of client funds or assets. You connect your own broker and/or exchange accounts and retain full responsibility and control.
  • Nothing on our website, in our software, or in our communications is an offer, recommendation, or solicitation to buy or sell any security, derivative, forex instrument, or crypto asset.

4. Trading Risk Warning

Trading in financial instruments (including crypto assets, forex, equities, and derivatives) involves substantial risk and is not suitable for everyone. You may lose some or all of your capital. In certain products and account types, losses may exceed the amount initially deposited with a broker or exchange.

Automated trading can amplify risk because software may place, modify, or cancel orders quickly based on configuration and market data.

5. No Promises of Profit; Past Performance and Hypothetical Results

Sun Cluster makes no promises of profit or performance. Past performance is not necessarily indicative of future results, and results may vary significantly.

If our materials ever include examples, simulations, backtests, or hypothetical outputs, those are for illustration only and do not represent actual trading. Hypothetical results have inherent limitations and are not a guarantee of future outcomes.

6. Client Responsibility

You are solely responsible for:

  • Selecting, configuring, and validating any strategy or automation.
  • Testing (including paper/sandbox testing) before live use and monitoring live activity.
  • Setting risk limits (position sizing, leverage, stop-loss logic, maximum drawdown controls, and kill-switch behaviour).
  • Understanding how orders may be executed (partial fills, slippage, latency, rejects, and market impact).
  • Complying with all applicable laws, exchange rules, broker terms, and any account restrictions.

You should obtain independent professional advice (financial, legal, tax) where appropriate before engaging in trading activities.

7. Third-Party Services, Brokers/Exchanges, and Data Providers

Our software may integrate with Third-Party Services such as brokers, exchanges, market data providers, cloud hosting providers, and notification services. Third-Party Services are not controlled by Sun Cluster and may change, degrade, or become unavailable without notice.

We are not responsible for outages, API changes, execution quality, pricing, fees, commissions, spreads, slippage, delays, rejected orders, or other issues caused by Third-Party Services.

You are responsible for reviewing and complying with the terms and risk disclosures of your broker/exchange and other Third-Party Services.

8. Technology and Operational Risks

Software systems can fail. Operational risks may include:

  • Bugs, configuration errors, or model/logic errors.
  • Connectivity issues, latency, or partial system outages.
  • Rate limits, API changes, or broker/exchange maintenance windows.
  • Data issues (missing, delayed, or inaccurate market data).
  • Security incidents affecting devices, credentials, or networks outside of Sun Cluster’s control.

We apply reasonable engineering and security practices, but no system can be made completely error-free or secure.

9. Security and Credentials

You are responsible for maintaining secure devices and protecting credentials (including API keys and broker logins). If you provide API keys or tokens for integrations, you should use least-privilege access and rotate keys as needed. If you believe credentials are compromised, revoke them immediately and notify your broker/exchange.

10. Availability and Support

Service availability may depend on Third-Party Services and your environment. Support response times and included support (if any) are defined in your order form, statement of work, or support agreement.

11. Jurisdiction and Compliance

Sun Cluster Inc. is based in Ontario, Canada. You are responsible for ensuring that your use of our website and Services is lawful in your jurisdiction. We may refuse service where we reasonably believe doing so is necessary to comply with law or reduce misuse risk.
